A: Only if the health care provider deviated from the applicable standard of care is Consent forms do not release health care providers when malpractice is involved. The healthcare provider who performed a negligently is still libel. It needs to be established that the health care provider did not follow the applicable standard of care and the patient's injury or disease was caused or aggravated substantially because of their actions. If the health care provider went beyond your consent, they may also be liable for battery, there a possible cause for a malpractice case. Medical results are not guaranteed, and unexpected or unsuccessful results are not always caused by negligence.
